If the Sub.Trustees are unable to convey good and marketable title,the
purchaser's sole remedy in law and equity shall be limited toarefund of
the deposit without interest. If the purchaser fails to go to settlement,
the deposit shall be forfeited, to theTrustees for application against all
expenses,attorney’s feesand thefull commissionon thesalepriceoft he
above-scheduled foreclosure sale.Inthe event of default,all expenses of
this sale (including attorney’sfees and the full commissionont he gross
salepriceofthissale)shallbechargedagainstandpaidoutoftheforfeited
deposit.TheTrusteesmaythenre-advertiseandresellthepropertyatthe
risk and expense of the defaultingpurchaser or may avail themselves of
any legal or equitable remedies against the defaultingpurchaser without
reselling the property.Inthe event ofaresale,the defaulting purchaser
shallnot be entitled to receive the surplus,ifany,even if such surplus
results from improvements to the property by said defaulting purchaser
and the defaultingpurchaser shall be liable to theTrustees and secured
party for reasonableattorney’sfees and expenses incurred in connection
with all litigation involvingthe Property or the proceeds of the resale.
