the deed from Elizabeth Tobin to Mary E. Haggerty and Dan-iel J. Haggerty dated June 17, 1966 and recorded with the

in the alternative a judgement that plaintiffs hold their titlefree from any claims of the defendants, the plaintiffs having

Pursuant to the provisions of Massachusetts General Lawschapter 23A, § 68(b), and in accordance with Massachu-
setts General Laws chapter 30A, section 2, notice is hereby
given that a public hearing will be held on Wednesday,September 25th, 2019 at 3:00 p.m., located at Conference
Room 1, 21st Floor, One Ashburton Place, Boston, MA,
02108, at which the Executive Office of Housing and Eco-nomic Development (EOHED) will receive oral comments
relative to the proposed new regulations at 400 CMR 4.00entitled “Public Registry of Lodging Operators.”


In December 2018, the Legislature enacted and the Gov-ernor signed chapter 337 of the Acts of 2018, An Act
Regulating and Insuring Short-Term Rentals (the “Short-
Term Rental Act”). Pursuant to section 1 of the Short-TermRental Act (as codified in section 68 of Chapter 23A of the
General Laws), EOHED, in consultation with the Executive
Officement of Revenue, shall establish and maintain a registryofTechnologyServicesandSecurityandtheDepart-
for all operators under chapter 64G who file an application
and are issued a certificate of registration in accordancewith section 67 of chapter 62C. EOHED also is required to
promulgate regulations that are necessary to: (i) develop
and implement a registry that is accessible and availableto the public; and (ii) support the competitive operation of
the traditional lodging industry, short-term rental industryand hosting platforms to operate competitively in the Com-
monwealth.The regulations at 400 CMR 4.00 are being pro-
posed to satisfy the latter requirement.

On May 16, 2019, Pinehills Water Company, Inc. (“Pinehills” or
“Company”) filed a petition with the Department of Public Utili-ties (“Department”) pursuant to G.L. c. 164, § 94 and G.L. c. 165,
§ 2 for approval of a general increase in rates as set forth inproposed tariffs M.D.P.U. Nos. 5, 6. Specifically, the Company
filed new rates designed to collect additional annual water
revenues of $806,642, which represents an overall increaseof approximately 42 percent over the Company’s currently ef-
fective rates. The Company proposes to implement the rateincrease in three steps over three years, with the first increase
of twelve percent becoming effective immediately. The Com-
pany last received a general rate increase in 2001. PinehillsWater Company, Inc., D.P.U. 01-42 (2001). The Department has
docketed this matter as D.P.U. 19-58 and suspended the effec-tive date of the proposed rate increase until April 1, 2020, to
investigate the propriety of the Company’s request.If the Department approves the Company’s petition as pre-
sented, a typical residential customer in Pinehills’ service ter-ritory using 5,000 gallons of water per month would receive a
monthly bill increase of $7.56 (12.7 percent) in the first step, an
additional monthly bill increase of $8.58 (12.8 percent) in thesecond step, and an additional monthly bill increase of $9.75
(12.9 percent) in the third step. This equates to a total monthlbill increase over the three steps of $25.89, or 43.4 percent.y

On June 3, 2019, the Department appointed Settlement Inter-vention Staff to act as a full intervenor in the proceeding in
order to promote negotiations and effect a settlement if fea-sible.
On February 14, 2019, the Company filed a separate petitionwith the Department pursuant to G.L. c. 164, § 94, and G.L. c.
165, § 2, seeking to establish new, lower private fire protec-
tion rates for connections less than four inches in diameter.The Department docketed this matter as D.P.U. 19-22. The De-
partment allowed the new rates to take effect March 1, 2019,subject to further investigation. Pinehills Water Company, Inc.,
D.P.U. 19-22 (2019). In accordance with 220 CMR 1.09, becausethe two dockets involve common issues of law and fact, the
Department has consolidated D.P.U. 19-22 and D.P.U. 19-58 forinvestigation.
The Department will conduct a public hearing to receive com-
ments on the Company’s proposal on5, 2019 at 7:00 p.m. at Plymouth South Middle School, 488Thursday, September
