with fine weather.
It wasunderstoodto be the first-
ever visitby No.1245 to anot her
heritag eline.The locomotive
worked at Falkir kuntil 1947 when
it wastransferredtothe company’s
Coke Ovens siteatBannockburn.
Twoyears later, it wastransferred
to the NationalCoal Board’s
BannockburnColliery.
It underwentamajorrebuild in

1959 at the AlloaCentralWorkshops.
Afte rspending 32years rusting
away,in2 004itwas boughtfrom
ThomasMuir Metal Merchants of
Kirkaldy,takento Haverthwaite,
restoredover 19 months and
repaintedintoCaledonian blue livery.
Duringthe gala, No.1245hauled
demonstration freighttrains,
tackling the 1-in-19gradientout
of FoxfieldColliery. Also grabbing
attention wasthe‘KnottyTrain’, now

running public services with three
restored NorthStaffordshireRailway
coaches between CaverswallRoad
and DilhornePark.The train proved
extremely popular with visitors.

MAINLine charters using heritage
carriagescould be stopped from
running after2023,under n ew rules
introducedfollowing the death of an
enthusiast whoputhis head out of a
Gatw ick Express carriage window–or
facebills running into millions,ithas
been claimed.

wasfined £1 million in July after
passenger Simon Brown, 24,was
struck on the headby atrackside
gantryasheleane dout of apublicly-
accessible windowonaClass 442
unit.The trainwasapproaching
WandsworthCommon station

at 61mphonAugust7, 2016.
At Southwark CrownCourt, the
firm pleaded guiltytoacharge of
failingto ensurethatpersons not in
their employmentwerenot exposed
to risk to their health and safety,
and in additionto the finewasalso
ordered pay£52,267.
Witnesses said thatMrBrownwas
looking out of the windowwhen he
wasstruc k. He wasfoundcollapsed
on the carriage floorby afellow
passenger,having sufferedamassi ve
traumato hishead.
Investigators said thatthe door
whichcontainedawarning sticker
telling passengers notto lean out
of the unlocked droplightwindow,

intendedforuse by conductors,was
“cluttered”with other signs.The gap
between the windowand the gantry
wasnomorethan260mm.
Afterthe tragedy,GTR installed
hazardtape and bars across
droplightwindows. GTR’s 14 Class
442s were withdrawnfromservi ce
in 2017.
TheOffic eofRail andRoad (ORR)
subsequently wrotetor ail operators,
including operators of BR Mk.
coaches,telling themto takeaction
to avoid asimilar tr agedy involving
droplightwindows. Mr Brown, who
came from EastGrinstead,had
volunteered at the BluebellRailway
when hewasjust nineyears old and

worked as an engineeringtechnician
with HitachiRail Euro pe in Bristol.
Judge Jeffrey Pegden QC said that
the signage around the window
was“confusing”, therewas no one
on boardtomonitor the use of the
windowatthe time and thatthe fi rm
had not carried outarisk assessment.
AstatementfromMrBrown’s
familyfollowing the sentencingwas
issued through the ORR and said:
“The family thanks the judgefor
reco gnising thatSimon’s needless
and untimely deathwasadirect
result ofGoviaThameslinkRailway’s
failuretodischarge its dutytoevery
passenger on theGatwick Express.
