teeth opening wide below the surface. You know the drill: Get the heck
out of the water and reach for the remote—it’s time for Discovery’s
annual festival of shark-infested programming, full of great whites,
tiger sharks and more. This year brings the week’s first-ever scripted
movie, Capsized: Blood in the Water (July 31, 9 p.m.). Josh Duhamel
plays a guy trapped in a crowded life raft. The raft preserves less life
than you might hope. (Discovery, kicking off July 28)

If you received a call from PHH
Mortgage Corporation or HSBC
Mortgage Corporation (USA) related
to a mortgage owned and/or serviced
by or on behalf of HSBC Bank USA,
N.A., you may be entitled to benefits
under a class action settlement.
A federal court authorized this notice.
This is not a solicitation from a lawyer.
A class action settlement has been reached in the
lawsuit Ahmed, et al. v. HSBC Bank USA, N.A.,
et al., No. 5:15-cv-02057, which is pending in
the U.S. District Court for the Central District
of California (“Court”). This lawsuit claims
that PHH Mortgage Corporation and HSBC
Bank USA, N.A. (“Defendants”), violated the
Telephone Consumer Protection Act (“TCPA”),
by (1) using an automatic telephone dialing
system to call cell phones without proper
consent, or (2) using an artificial or prerecorded
voice. Defendants deny they did anything wrong.
Who is included? You may be a “Class
Member” if you are a person whom Defendants
called using a dialing system on a cell phone
number between October 6, 2011 and January
18, 2019, regarding mortgages owned and/or
serviced by or on behalf of Defendant HSBC
Bank USA, N.A., and you did not consent to
receive such calls.
Summary of the Settlement: Defendants
agreed to pay $2,400,000 into a Settlement Fund
that will be used to pay cash awards to Class
Members who submit a valid and timely claim,
pay Class Counsel’s attorneys’ fees of up to 25%
of the settlement amount, pay Class Counsel’s
actual costs, pay a service award to the Class
Representatives of $5,000 each, and pay costs
and expenses of settlement administration. Any
remaining monies from uncashed settlement
checks may be redistributed to Claimants or paid
to a non-profit organization, with the proposed
recipient(s) to be posted on the Settlement Website.
What Should I Do? Class Members have
four options:
(1) Submit a Claim online at
http://www.phhtcpasettlement.com or by mail to
HSBC/PHH TCPA Settlement, c/o JND Legal
Administration Co., P.O. Box 11035, Seattle,
WA 98111-9035, no later than November 4,
2019. If you fail to submit a claim, you will not
receive a settlement payment.
(2) Remain a Class Member but Object
to the Settlement. Instructions for objecting
are available at http://www.phhtcpasettlement.com.
Objections and supporting documents must be
postmarked no later than November 4, 2019.
(3) Exclude yourself from the Settlement.
Instructions for opting out of the Settlement
are available at http://www.phhtcpasettlement.com.
Exclusions must be signed by you and
postmarked no later than November 4, 2019.
(4) Do Nothing. If you do nothing, you will remain
part of the Settlement Class and will release your
claims against the Released Parties, but you will
not receive any money from this Settlement.
Do I have a lawyer? The Court has appointed
lawyers from the following firms to represent
Class Members: Burke Law Offices, LLC, Terrell
Marshall Law Group PLLC, Law Offices of Todd
Friedman, P.C., Mazie Slater Katz & Freeman,
LLC, Hyde & Swigart, and Kazerouni Law
Group, APC. The lawyers will be paid from the
Settlement Fund. You may enter an appearance
through your own attorney if you so desire.
Scheduled Hearing: The judge scheduled a
hearing for December 12, 2019, at 10:00 a.m. at
the United States District Court for the Central
District of California, United States Courthouse,
350 W. 1st Street, 6th Floor, Courtroom 6D,
Los Angeles, CA 90012, regarding whether to
give final approval to the Settlement. It is not
necessary for you to appear at this hearing,
but you may attend at your own expense.
