2017 is now used to define an NRI.
The judgment first specifies a limited
reservation of such seats, not exceeding
15% for NRI students before detailing
who could fall under the NRI category.
It also mentions that Persons of Indian
Origin (PIO) and Overseas Citizen of
India (OCI) students also come under
the NRI quota.
Who can sponsor a student
under NRI category?
The sponsoring NRI can be any one of
the following:
1.The mother or father of student is an
NRI residing abroad.
- First degree relation of the student
who is an NRI and residing abroad ordi-
narily including, the real brother and
sister over and above the mother-father
of the first degree relation. - A person who is an NRI residing
abroad and wishes to consider a student
as a ward (Palya) in compliance of the
following conditions. He should be the
nearest relation as follows:
OReal brother and sister of father i.e. real uncle
and real aunt.
OReal brother and sister of mother i.e. real
maternal uncle and maternal aunt.
OFather and mother of father i.e. grandfather
and grandmother.
OFather and mother of mother i.e. maternal
grandfather and maternal grandmother.
OFirst degree-paternal and maternal cousins.
The MCC website cites the follow-
ing documents as mandatory for NRI
applications:
OPassport copy of sponsorer
OEmbassy certificate
OSponsorship affidavit (stating that sponsorer
is ready to bear the expenses for the whole
duration of study)
ORelationship Affidavit (Relation of candidate
with the sponsorer)
It is clause number 3 that is misused
for admissions of Indian students under
the NRI quota as an affidavit can be
easily procured and is being done. It is
common for many students and parents
to ask about the regulations and then
find a relative or friend to go along with
the scheme.

Counselling 2019 has a notice dated
June 24, 2019 that lists 240 students
who have been allowed to change their
category from Indian to NRI on the
basis of the clauses mentioned above.
These were the ones who had registered
as Indians and can now participate as
NRIs. The others with an intention to
change have been asked to apply in the
second round with relevant and correct
documents. This is just for one bit of
the actual counselling process which if
multiplied for each state completes the
overall NRI admission picture.

What should be understood is that once
this change is incorporated in the regis-
tration process, it is not possible for any
student to use his Indian status to apply
for the seats available for the same. This
rules them out of the spot rounds, mop
up rounds that otherwise may give them
a chance at admissions to the seats at
the same colleges for a lower cost.
NRI students and 15% All
India Quota (AIQ) counselling
While NRI students have to participate
in the general category for the 15% AIQ
seats, they can avail the NRI quota in
deemed universities which offer 1068
MBB seats and 363 BDS seats through
the All India counselling process.
NRI quota in state
counselling
Most states have a separate NRI quota
for the private colleges which gener-
ally is 15%. Some states like Andhra
Pradesh, Telangana, Uttar Pradesh etc.
conduct the Management and NRI
counselling separately, while some like
Karnataka allot seats through the com-
bined counselling.
Note: In Maharashtra, Non-Resident Indian
(NRI) candidates are eligible for the institutional
quota seats only. They are not eligible for any
other seats while OCI candidates are eligible for
Government/Corporation/Government Aided/
Private unaided colleges provided they are domi-
ciled in the state and have studied there for a
minimum period of 10 years.

Q. Who are eligible for NRI cat-
egory?
A. Applicant/either of the parents/
first degree relation, sibling OR
maternal or paternal - uncle/aunt/
grandparents/first degree cousins
who are non-resident Indians ordi-
narily residing abroad.
**In case of a direct relation- such
a person must have looked after the
student. An affidavit for the same
should be submitted.
Q. Can OCI/PIO candidates apply under
NRI quota?

Q. Are OCI/PIO/NRI candidates eligi-
ble for Management Seats of Deemed and
15% AIQ seats?
A. Ye s.
Q. Can candidates remit the Registra-
tion Fee and Security Deposit from NRI
Account?
A. No. As per RBI Rules, MCC can-
not refund security deposit to NRI
accounts. Candidates must first
transfer funds from NRI Account
to NRO Account and from there to
MCC. The refund from MCC will
be credited to the NRO Account.
