Treaty of Defensive Alliance between France and Savoy


or ought hereafter to enjoy and poffefs, even without Europe,
and in any part of the World whatfoever, by common Law, or
according to Treatys already made or to be made hereafter, in
manner as aforefaid; the moft Serene Kings, when defir’d and
requir’d by one another, fhall exert all their Power and Study
that fuch Hoftility or Moleftation may ceafe, and that the Loffes
and Injurys done to either of the Confederates may be repair’d.
But if they cannot do it in an amicable way within four Months,
and that Confederate who fhall be fo invaded or difturb’d out of
Europe,in whatfoever part of the World it be, is compell’d to
employ his Arms againft the Difturber or Invader in Europe,that
he may be reduc’d to embrace an equitable Peace, the other
Confederate who is not invaded or difturb’d fhall be oblig’d to
fend the Succours aforefaid to him who is invaded or difturb’d,
and afterwards to join in open War againft the Difturber or
Invader, in the fame manner altogether as if the Invafion or
Moleftation had happen’d within the Limits ofEurope.
VIII. When once a War is broke out among the Confederates
according to this Treaty, it fhall not be in the Power of either of
the Confederates to enter into any Ceffation of Arms betwixt
himfelf and the Enemy, unlefs jointly and by common Confent.
IX. But in cafe a Treaty of Peace be propos’d, or a Truce for a
certain number of Years, neither of the Confederates fhall begin
it without the Participation of the other, and unlefs the Party
which is inclin’d to enter into the Treaty procures the neceffary
and ufual Full Powers and Safe Conduft for the other Party, at
the fame time as for himfelf, that he may fecurely fend his
Minifters to the Place appointed for the Treaty, and unlefs he
fucceffively and from time to time communicate to him all the
Matters negotiated in fuch Treaty of Truce or Peace; and neither
of the Confederates fhall confent to the Conclufion of the faid
Peace or Truce without including the other Confederate in the
fame, and without ftipulating for his Reftoration, if he think fit,
to the Poffefiion of the Dominions, Lands and Places, and of all
his Rights and Immunitys which he us’d and enjoy’d before the
War, and alfo without obtaining for his Confederate from the
common Enemy thofe Rights, Immunitys, Exemptions, and
Prerogatives, which he bargains for himfelf, unlefs it be other-
wife agreed upon between them.
X. And in order to make the beft Provifion poffible, that the
fincere Application of the moft Serene Kings, for eftablifhing
the ftricteft Amity and Union by the prefent Treaty between
themfelves and their Dominions and Subjects on both fides,
may not be liable to any Variation whatfoever, ‘tis not only
agreed that it fhall not be lawful either for the moft Serene King
ofGreat Britain,or the moft Serene King ofSpain,to enter into
any Convention hereafter contrary to this, but alfo that he fhall
not enter into any Treaty without including the other Confeder-
ate in it, if he pleafes, and without fuch a timely Communica-
tion to him of all the Negotiations, that he may declare his
Opinion as to his being included accordingly.
XI. And whereas ‘tis the principal Aim of this League that the
publick Tranquillity and Peace reftor’d to Chriftendommay
remain undifturb’d and inviolable, the moft Serene Emperor of


the Romans,as well as other Kings, Princes and States, fhall be
defired to enter into thofe Schemes and Counfels with both of
the Confederates, which may be moft conducive to fo falutary a
Purpofe; and efpecially all Endeavours fhall be us’d on both
fides that the Treatys lately concluded at Nimeguen(by which
Peace is reftor’d to Chriftendom) may remain and be continued
in full force.
XII. The Treaty of Peace and Friendfhip enter’d into between
the moft Serene Kings at Madrid, Anno1667, and another Treaty
concluded likewife at Madrid, for eftablifhing Peace, &c. in
America,between the Kingdoms ofGreat Britainand Spain,and
alfo all other Treatys and Conventions between the moft Serene
Kings, fhall be fincecely obferv’d in their feveral Articles; and not
only the moft Serene Kings, but their Subjefts on both fides, fhall
freely and effectually enjoy and poffefs all Things therein ftipu-
lated, whether they relate to the Publick or to Private Affairs.
XIII. This League fhall continue and be in force till the day
ofAuguft,1693. and before the Expiration of that fpace of Time
the faid moft Serene Kings fhall agree between themfelves on
the farther Prolongation thereof for the publick Good; and the
prefent Treaty fhall be ratify’d on both fides within two Months,
to be computed from the Date of the Subfcription. Done at
WindforCaftle, the 10th day ofJune,A. D. 1680.

Separate Article
Tis agreed and concluded by the prefent feparate Article, that if
the Lords the States General of the United Provinces of the
Netherlandsfhall think fit to augment the number of the Forces
mention’d in the 4th and 7th Articles of the Treaty enter’d into
by the King of Spain and Them on the 30th ofAuguft, Anno
1673, either by Ships or Marines, the moft Serene King ofGreat
Britainpromifes, that he will alfo fend the like number of Men
of War to the Affiftance of the moft Serene King of Spain,
befides thofe Forces which have been mutually agreed to in the
4th and 7th Articles of this Treaty.
