Customary marriages
Customary marriages have come a long way in
SA, and today the conclusion of such a marriage is
governed by the Recognition of Customary Marriages
Act. Ancestral traditions and rituals must be upheld
and in fact be complied with for it to be valid in terms
of the legislation.
A customary marriage is automatically deemed
to be a marriage in community of property, unless
an antenuptial contract is concluded to specifically
exclude such consequences, according to a note from
Cliffe Dekker Hofmeyr.
Therefore, customary marriages need to be given
proper thought, because if a spouse is already married
to someone else in or out of community of property, all
spouses need to be aware of the consequences of a
subsequent marriage, says Von Ludwig.
She says that the parties to the marriage will
need to consider the nature of the first marriage to
determine if they can have a second or subsequent
marriage, and what regime will govern it. The second
customary marriage will have to be governed by an
antenuptial contract. ■
