You maybe entitled to beneits from a $45.33 millioncommon fund or a separate $20 million claims-made settlement.The lawsuit claims these panels are defectiveand prone to junction box failures, which couldcause burn marks at the junction box, shatteredglass, and be a potential ire hazard. BP andHome Depot deny these claims.Who’s Included?The Settlement includes anyone in the UnitedStates who: (1) purchased certain BP solarpanels for installation on a property, or(2) currently owns a property on which thesepanels are installed and, in either case, who stillowns some or all of the BP solar panels.The panels were sold through variousdistributors and retailers, including but notlimited to Solar Depot and Home Depot.What does the Settlement provide?The Court approved a $45.33 million CommonFund to pay for the removal and replacementof a subset of Class Panels (Category 1), andto pay administration, attorneys’ fees andcosts, and Class Representative awards. TheCourt also approved the separate $20 millionClaims Made Fund for the remaining ClassPanels (Category 2), which have a lower failurerate. Category 2 claimants will be entitled toa free visual inspection to identify any failedpanels, a replacement of failed panels, and afree inverter with arc fault detection; or if over20% of panels have failed, replacement of allpanels. Nonresidential class members with400 or more Class Panels will be invited tocommercial negotiations.How can I receive beneits?You must ile a claim to receivebeneits.
