SUMMARYSTATEMENT
Under current law,employers of employees classified as “tipped
workers”may take acredit against tippedwages receivedby workers
to satisfythe minimum wageguaranteedtoall workers by law.If
enacted,the Initiative would graduallyeliminate the credit, such
thatthe mandatorybase wage(currently $5.05perhour, indexed
to inflation) paid by employersshall increase until 2027, whenthe
mandatorybase wagematchesthe minimum wageestablishedby
District of Columbialaw (currently $15.20 per hour,indexed to
inflation). Tips continueas property of employees and will be in
addition to the statutoryminimum hourly wage.
LEGISLATIVETEXT
BE IT ENACTED BY THE ELECTORS OF THE DISTRICT OF COLUMBIA,
That this act
maybecited as the “Districtof Columbia Tip Credit EliminationAct of
2021.”
Sec.2.Section4ofthe MinimumWage Act Revision Act of 1992,
effectiveMarch25,
1993(D.C. Law 9–248;D.C.Official Code§32–1003), is amended as
follows:
(a) Subsection (f) is amendedtoread as follows:
“(f)(1) Forpurposes of this subsection, the term“tipped minimum
wage”shall mean theminimumhourly wage requiredtobepaid by an
employer to an employee who receivestips.
“(2)AsofJuly 1, 2021, the “tipped minimumwage” shall be $5.05 an
hourwith tips on top; provided, thatthe employeeactuallyreceives
tips in an amountat leastequal to the difference betweenthe hourly
wagepaid and the minimum wageas set by subsection (a) of this
section. This tippedminimumwage will increase on July 1, 2022in
proportiontothe annual average increase,ifany,inthe Consumer
Price Indexfor All UrbanConsumers in the WashingtonMetropolitan
StatisticalArea published by the BureauofLabor Statisticsof the
United States Department of Laborfor the previouscalendaryear.
Any increaseunderthis paragraph shall be adjustedtothe nearest
multiple of $.05.
“(3)Exceptasprovidedin subsections (h) and (i) of this section,as
of January1, 2023, the tippedminimumwage shallbenot less than
$6. 00 anhourwithtipsontop;provided,thatthe
employee actually receives tips in an amount at least equalto the
difference between the hourly
wagepaid and the minimum wageas set by subsection (a) of this
section.
“(4)Exceptasprovidedin subsections (h) and (i) of this section, as of
July 1,2023,the tippedminimumwage shall be not less than $8.00 an
hour,with tips on top;provided,thatthe
employee actually receives tipsinanamount at least equalto the
difference between the hourly
wagepaid and the minimum wageas set by subsection (a) of this
section.
“(5)Exceptasprovidedin subsections (h) and (i) of this section, as of
July 1, 2024, the tipped minimumwage shall be not less than $10.00
an hour,with tips on top;provided,that the
employee actuallyreceives tipsinanamount at least equalto the
difference between the hourly
wagepaid and the minimum wageas set by subsection (a) of this
section.
“(6)Exceptasprovidedin subsections (h) and (i) of this section, as of
July 1, 2025, the tipped minimumwage shall be not less than $12.00
an hour,with tips on top;provided,that the
employee actuallyreceives tipsinanamount at least equalto the
difference between the hourly
wagepaid and the minimum wageas set by subsection (a) of this
section.
“(7)Exceptasprovidedin subsections (h) and (i) of this section, as of
July 1, 2026, the tipped minimumwage shall be not less than $14.00
an hour,with tips on top;provided,that the
employee actuallyreceives tipsinanamount at least equalto the
difference between the hourly
wagepaid and the minimum wageas set by subsection (a) of this
section.
“(8)Exceptasprovidedin subsections (h) and (i) of this section,as
of July 1, 2027, the tippedminimum wage shall be not less than the
minimumwage as set by subsection (a) of this section, with tips on
top.”
(b)Anew subsection (i) is addedto read as follows:
“(i) The provisionsofsubsection (f)(2), (3), (4), (5), (6), and (7) of this
sectionshall not apply to employees of the Districtof Columbia,or
to employeesemployed toperform services providedundercontracts
withthe Districtof Columbia.Those employees shall continue to be
subjecttothe minimumwagerequirements of the Minimum Wage
ActRevision Act of 1992,effective March25, 1993 (D.C.Law 9–248;
D.C. OfficialCode §32– 1001 et seq.), as amended by the Enhanced
Professional SecurityAmendment Act of 2008,effective March20,
2008(D.C. Law 17–114; 55 DCR 1276),asamended by the Minimum
Wage Amendment Act of 2013,effectiveMarch 11, 2014 (D.C.Law
20–91; 61 DCR778), as amended by the Fair Shot Minimum Wage
Actof2016 (D.C.Law 21-144; 63 DCR 9275)as they existedbefore
the effectivedate of the District of Columbia Full Minimum Wage for
Tipped Workers Amendment Act of 2022,and to the requirementsof
all other applicablelaws, regulations,orpoliciesrelating to wagesor
benefits,including the Living Wage Actof2006, effective June 8, 2006
(D.C.Law 16–118;D.C.Official Code§2–220.01 et seq.).”.
Sec.3.Nothingin this act shall be construedas preventingthe
Council of the Districtof Columbia from increasing minimum wages
or benefitstolevels in excess of those provided for in this act for any
category of employees.
Sec.4.Nothinginthis act shall be construed aspreventingemployers,
during any periodin which subsection(f)(7) of this sectionis in
effect, from implementing amandatory tip sharingpolicy amongall
employees,regardless of whether such employees normallyreceive
tips
Sec.5.Ifany sectionofthis act or its applicationtoany persons or
circumstances is held invalid, the remainder of this measure, or the
applicationofits provisionstoother personsor circumstances,shall
notbeaffected.Tothis end,theprovisions of this act are severable.
Sec.6.This act shall take effect after a30-day periodof congressional
review as providedinsection602(c)(1) of the Districtof Columbia
HomeRule Act, approvedDecember 24, 1973 (87 Stat. 813; D.C.
Official Code§1-206.02(c)(1)).
