Adizzyingarrayofrequirements
On January13, 2022,the SupremeCourthalted a Biden
Administrationemergencyrule that would haverequired
companieswith 100 or moreemployees to require
covid-19vaccinationsor weekly testingat the employee’s
own cost. (The courtdid allowa vaccinemandateto
moveforward for healthcareworkers at facilitiesreceiving
Medicare/Medicaid funds.) Eliminationof a federal
mandatemeansvaccinerequirementsare now left up to
states,counties,citiesandemployersthemselves.
Acrossthe U.S., you will find a wide range of scenarios,
fromgoverningjurisdictionsrequiringemployer vaccine
mandatesto governingjurisdictions prohibitingemployer
vaccinemandates. Meanwhile, federal employeesare
currentlyin an interestingsituation:whileundera stated
vaccinemandate, federal agencieshavebeendirected
not to take actionto implementit due to the Supreme
Courtruling.

Whilethecourtssortthisout,jobseekersshouldknow
several things:
Althoughsomejurisdictionsare operatingunder
executiveordersbanningemployervaccinemandates,
ingeneral,federalEqualEmploymentOpportunity
(EEO)laws do not prohibitan employerfromrequiring
employeeswhowillphysicallyentertheworkplacetobe
fully vaccinatedagainstcovid-19.

However,underTitleVIIoftheCivilRightsActandthe
Americanswith DisabilitiesAct (ADA),employersmust
offer“reasonableaccommodations”—thatis,theymust
exemptemployeesfromvaccinationrequirementsfor
medicalor religiousreasons.

This is whereit gets tricky. UnderEEO laws, a
potentialemployercanaskwhetherajobcandidate
is vaccinated—butthey cannotask for medical
informationto accompanyproofof vaccine, though
the candidatemay chooseto provideit. Nor can a
job candidatebe asked why they havechosennot to
get vaccinated. The follow-upquestioncouldreveal
informationrelatedto disabilityor religiousbeliefsthat
is illegalto considerin the hiringprocess.
Bestpracticesyoushouldexpectfrom
employers

The Societyfor HumanResource Management
(SHRM)recommendsnot askingwhy a candidate is
not vaccinateduntil after a job offeris made. That’s
one of several best practicesSHRM has publishedfor
employers. Anotheris to only ask job candidates
abouttheirvaccination statusif existing employees
are also asked if they’re vaccinated.That is because
vaccineinquiries shouldpertainto the job and
workplace safety.

SHRMalso recommendsemployersbe transparent
aboutvaccinerequirementsas early as possiblein the
hiringprocessand evenincludethe requirementand
informationaboutthe availabilityof accommodationsin
the job posting.

If you are attendingan in-personinterview, a
potentialemployercan ask whetheryou are currently
experiencingcovid-19symptomsbecausethat is a
workplacesafetyissue. However, if you are asked
whetheryou haveever testedpositivefor the virus, that
mightviolatethe ADA.
Any informationyou providean employer or potential
employerregardingyour covid-19vaccinationstatus or
requestfor accommodationsshouldbe kept confidential,
just like your SocialSecuritynumber shouldbe kept
confidential.Only thosecoworkers who havea business
reasonto knowyour statusshouldhave accessto it.
Whatif youneedan exemptionfor
medicalor religiousreasons?

If you do needto seek accommodationfroman
employervaccinerequirement,whetherfor medical

or religiousreasons, a suitabletime to let your
new employerknow is after you haveacceptedthe
positionbut beforeyour start date. The “reasonable
accommodation”processis an interactiveprocess,
meaningtheremay be somebackand forthbetween
you and your new employerregardingrequired
documentation.If this is the case, you will want to
get startedas soonas possible so as not to delayyour
start date.

Employervaccinerequirements are just another
confusingarea in the covid-19world.Knowingyour

sometensionout of the already-stressful hiringprocess.
