days, with all but one of the
12 juro rs ultimatelyvoting to
acquit Baca. After the panel
announced it was dead-
locked, Anderson declared
the mistrial.

Baca’s attorney, Nathan
Hochman, said,“The gov-
ernment will make its deci-
sions based on whatever cal-
culations itwants to make.
Traditionally, many11-to-
cases haven’t beenretried.”
Theretrial is scheduled
to beginFeb. 21.
Although it offered only a
momentary reprieve for
Baca, theverd ict dealta set-
back forU.S. Atty. Ei leen M.
Deckerand the prosecutors
from her office’s Public Cor-
ruption and Civil Rights
Section that pursued the74-
year-old former sheriff.
Before levelingcharges
against Baca, Assistant U.S.
Atty. Brandon Fox, who
heads the anti-corruption
unit, had methodically
worked hisway through the
group of rank-and-file depu-
ties and supervisors who
wereaccused of havingroles
in theobstructioneffort. In
all, nine people have been
convicted or have pleaded
guilty, including former
Undersheriff Paul Tanaka,
who ran much of the sprawl-
ing agency’s day-to-day op-
erations andwas ac cused of
spearheadingthe campaign
to derail the FBI jail investi-
gation.
At last month’s trial,Fox
attempted to show that
Bacawas the “heartbeat” of
the obstruction operation
and hadkept abreast of the
effort as it unfolded over six
weeksin20 11.Theprosecutor
argued that deputies
carriedoutordersto conceal
from agents the where-
aboutsofaninmatewhowas
working as an informant,
pressured other deputies
not to cooperate with the in-
quiry and tried to intimidate
theleadFBIagentbythreat-
ening her with arrest.
Few of thegovernment’s
witnesses, however, testified
to direct interactions with
Bacaduring the time of the
alleged obstruction, and
there was less hard evidence
that implicated the former
sheriffthan his underlings.
Jurors, except for the lone
holdout,believed the case
was weak and circumstan-
tial.
Fox and Decker had tried
to avoid taking Bacato trial,
optingto strike a plea deal
with him early lastyear that
called for Bacato admit to a
less seriouscharge of mak-
ing falsestatementsto fed-
eral investigators during an
interview. Inexchange, Baca
would serve no more than
six months in prison.
Anderson, who had han-
ded down stiff sentences in
the previous trials,rejected
the deal as too lenient and
made clear he intendedto
sentence Baca to signifi-
cantly more time behind
bars. Bacachoseto with-
draw his guilty pleaand take
his chances ata trial.
In trying to convince An-
derson that the dealwas ap-
propriate, Fox acknowl-
edged incourt papers that
the government’s case
against Baca was weaker
thantheoneagainstTanaka
and more circumstantial.
Despite that assessment
and the lopsidedverdict in
the first trial, itwas notsur-
prising the government
optedto press ahead with a
retrial, legalexperts said.
Miriam Krinsky, a former
federal prosecutor who led a
commission on violence in
the county jails and who has
closely followed the trial,
said theU.S. attorney’s ag-
gressive prosecutions of the
lower-level sheriff’s officials
meant therewaslittlechoice
but to keep the pressure on
Baca.
“Fairness and equity de-
manded themto give it an-
othergo,” she said.
And attorneyKen Julian,
another former assistant
U.S. attorney who prose-
cuted former Orange
County Sheriff Michael
Carona on corruption
charges, said itwould have
been unusual if Decker had
backed off.
“The U.S. attorney’s ap-
proachto thehigh-levelpub-
lic officials has always been
to go after them hard,”
Julian said. “So on that level,
it is nota surprise they are
taking another shot at him.”
Heading into the first tri-
al, Baca, who is in theearly
stages of Alzheimer’s dis-
ease, faceda charge of mak-
ing false statementsto in-
vestigators— the charge to
which hehad pleadedguilty
—as well as the conspiracy
and obstruction charges.
Baca’s attorney, Nathan
Hochman,announced that
he plannedto use Baca’s de-
teriorating mind asa de-
fense against the lying
charge.
That led the judge to
raiseconcerns thatjuro rs’
view of Bacawould be un-
duly tainted bytestimony
about thedisease. At the
judge’ s urging, prosecutors
movedto dividethecaseand
have a separate jury decide
later on the false statements
charge.
Although the decision
kept any mentionof Baca’s
illness out of the trial, it also
prevented prosecutorsfrom
making the caseto juro rs
thatBacahadliedto investi-
gato rs to cover up obstruc-
tion efforts.
Those restrictions had
hamstrung the govern-
ment’s case,Fox saidTues-
day as he asked Andersonto
include the false statements
charge in the retrial. The
judge readilygranted the re-
quest.
Althoughhe had initially
been opposed to the ideaof
severing the lyingcharge,
Hochmanon Tuesday tried
to persuadeAndersonnotto
rejo in thecharges in a sing le
trial. Hetold thejudge the
governmentwas making the
move purely for “strategic
reasons” andwas acting in
bad faith. Andersoncut the
attorney off, saying, “The
matter is closed.”
Hochman’s objections
werestrategicas well. Dur-
ing thefirst trial, he success-
fully hammered on the idea
that Bacawas a transparent
leaderas sheriff with noth-
ing to hidefrom federal in-
vestigators. That argument
willbemoredifficultto make
