Abstract :
This analytical study is summarized in highlighting the position of the
parliamentary opposition through the legal framing of the internal system of the
two chambers of parliament, as the Moroccan constitution consecrated this
essential component in the two chambers, neither in terms of its role in
legislation nor in terms of oversight.
The consecration of the rights of the parliamentary opposition in the
Moroccan constitution is a qualitative leap in the way of consecrating the virtues
of participatory democracy and the conduct of public affairs, and that the matter
remains dependent on the proper implementation of these goals and the proper
interpretation of their texts by the legislator through the internal systems of
parliamentary councils and by the constitutional councils or equivalent in their
capacity as protectors of rights And freedoms that include the rights of the
parliamentary opposition. consequently, the internal system of the two houses
of Parliament was obligated to submit to the constitutional rule - and from this
standpoint, space was allocated for the position of the opposition in Parliament,
by organizing the rights related to it, stipulated in Article 10 of the 2011
Constitution.
These rights relate to the actual exercise of legislation and oversight over
government work, as well as strengthening the presence of the opposition in
parliamentary committees as well as parliamentary diplomacy, in addition to
proposing members of the Constitutional Court, and the parliamentary
opposition carries out its tasks through the means of work that it is authorized
financially and humanly.
