INTENT TO REQUEST RELEASE OF FUNDS

On or about September 9, 2024, the City of Battle Creek will submit a request
to the HUD for the release of HOME funds under Title II of the Crans-
ton-Gonzalez National Affordable Housing Act of 1990, as amended, to under-
take a two projects known as 25 N Woodlawn, Battle Creek, MI 49037, and 273
W Spaulding, Battle Creek, MI 49037, for the purpose of new construction of
residential properties to be sold to low- to moderate-income households.
The activities proposed comprise a project for which a finding of no significant
impact on the environment was published on August 22, 2024. An Environ-
mental Review Record (ERR) that documents the environmental determina-
tions for this project is on file at the City of Battle Creek, 10 N Division Street
Suite 104 Battle Creek MI 49014 and may be examined or copied weekdays 8
A.M. to 5 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to
City of Battle Creek, 10 N Division Street, Suite 104, Battle Creek, MI 49014.
All comments received by August 29, 2024, will be considered by the City of
Battle
Creek prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The City of Battle Creek certifies to HUD that Rebecca L. Fleury in her capacity
as City Manager consents to accept the jurisdiction of the Federal Courts if an
action is brought to enforce responsibilities in relation to the environmental re-
view process and that these responsibilities have been satisfied. HUD’s approval
of the certification satisfies its responsibilities under National Environmental
Policy Act (NEPA) and related laws and authorities, and allows Battle Creek
Area Habitat for Humanity, as a Community Housing Development Organiza-
tion and as a Developer to use HOME
Investment Partnership Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the City of Battle
Creek certification received by September 9,
2024, or for a period of fifteen days, following its actual receipt of the request
(whichever is later) only if they are on one of the following bases: (a) the certi-
fication was not executed by the Certifying Officer of the City of Battle Creek;
(b) the City of Battle Creek has omitted a step or failed to make a decision or
finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient
or other participants in the project have committed funds or incurred costs not
authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or
(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted
a written finding that the project is unsatisfactory from the standpoint of envi-
ronmental quality. Objections must be prepared and submitted in accordance
with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be ad-
dressed to the U. S. Department of Housing and Urban Development –Detroit
Field Office, Keith E. Hernandez, Director, Community Planning and Develop-
ment at 477 Michigan Ave, Suite 1600, Detroit, MI 48226 or DetroitCPD@hud.
gov. Potential objectors should contact HUD to verify the actual last day of the
objection period.
