NOTICE OF CODE OF ORDINANCES
AMENDMENTS AND SYNOPSIS OF BOTH
CC ORD. #03-24
PUBLIC NOTICE IS GIVEN that at a regular meeting of the Board for the City of Springfield held at the
City Offices on September 16, 2024, the Council adopted the following code of ordinances:
AN ORDINANCE TO REPEAL CHAPTER 36, ARTICLE II, DIVISION 4, SECTION
36-91, ENTITLED “OPEN BURNING PROHIBITED”, AND TO ADD ARTICLE
III TO CHAPTER 20, SECTION 20-50 THROUGH SECTION 20-65, ENTITLED
“OUTDOOR BURNING”, OF THE CODE OF ORDINANCES FOR THE CITY OF
SPRINGFIELD
THE EFFECT OF EACH ORDINANCE AMENDMENT IS SUMMARIZED AS FOLLOWS:
Section 1. Amendment of Ch. 36, Art. II, Div. 4, Sec. 36-91. Provides that the provisions of Chapter
36, Article II, Section 36-91 of the Code of Ordinances, City of Springfield, Michigan, are hereby
repealed and reserved.
Section 2. Amendment of Ch. 20, Art. III, Sec. 20-37 through 20-50. Provides that the provisions of
Chapter 20, Article III, Section 20-37 through 20-50 of the Code of Ordinances, City of Springfield,
Michigan, are hereby reserved.
Section 3. Addition of Ch. 20, Art. III, Sec. 20-50 through 20-65. Adds Article III to Chapter 20, of
the Code of Ordinances, City of Springfield, Michigan Sections:


  • 20-50 “DEFINITIONS” added to include defining the following terms as used in this Section:
    clean wood, construction waste, fire hazard, incinerator, open burning, recreational fire,
    recreational wood-burning unit and refuse;

  • 20-51 “PROHIBITIONS” added to include subsections (a) allows for open burning unless
    prohibited by this chapter, (b) lists the items that shall not be burned unless permitted by
    this chapter, (c) offensive or objectional burning and the authorities authorized to extinguish
    the offensive or objectional burning;

  • 20-52 “PERMITTED OPEN BURNING” added subsections to include the types of open burn-
    ing that shall be permitted (a) controlled burns for training of firefighters, (b) prevention
    or control of disease or pests, and maintained by the fire department or other appropriate
    agency, (c) recreational fires;

  • 20-53 “BURNING REQUIRING A PERMIT” added subsections to provide the types of burning
    that necessitates a burning permit (a) bonfires, (b) burning of branches;

  • 20-54 “BURN PERMITS” added subsections to include (a) day-of permits, (b) the issuance
    or denial of burns with permits if relevant to public safety, (c) authority to cancel or revoke
    a permit if the burn may pose a fire hazard, (d) who can submit the application, (e) annual
    permits;

  • 20-55 “ATTENDANCE” added subsections to include (a) who shall be in attendance of a
    burn, (b) a portable fire extinguisher complying with Section 906 of the International Fire
    Code shall be available at a burn;

  • 20-56 “OUTDOOR INCINERATORS” added subsections to include (a) permitted only on
    premises occupied by commercial, government or industrial buildings, (b) a permit to install
    shall be issue by the State Air Pollution Control Commission, this application shall be ob-
    tained and filed with the City Building Inspection Division;

  • 20-57 “ENFORCEMENT” amend subsection (a) provides the violation of this article shall
    be a municipal civil infraction; subsection (b) provides who can issue the municipal civil
    infraction; and

  • 20-58 through 20-65 Provides that the provisions of Chapter 20, Article III, Section 20-58
    through 20-65 of the Code of Ordinances, City of Springfield, Michigan, are hereby reserved.
    Section 4. Conflict. Nothing in this Ordinance is to be construed to conflict with existing City ordi-
    nances except as otherwise stated herein. Nothing in this Ordinance is to be construed to conflict
    with any other law of the State of Michigan.
    Section 5. Repealed. All ordinances or parts of ordinances in conflict with this Ordinance are re-
    pealed.
    Section 6. Savings Clause. The provisions of this Ordinance are severable. If any part of this Ordi-
    nance is declared void or inoperable for any reason, such declaration does not void any or render
    inoperable any other part or portion of this Ordinance.
    Section 7. Effective Date. Provides that the Ordinance is effective immediately following its publi-
    cation in the manner permitted by law.

    ED, COPIED, OR REVIEWED AT THE CITY CLERK’S OFFICE.
